Luxon directs Willis to draft principles for the sector

Prime Minister Christopher Luxon said the way the Greens had positioned their statement was "quite alarmist". A day later he directed officials to begin work on a set of principles for the sector. Economic Growth Minister Nicola Willis and the Department of the Prime Minister and Cabinet have the task, 1News reported on 27 July 2026. The Ministry of Business, Innovation and Employment is also engaged, and Luxon said he wants input from the energy sector and from data centre operators.

"Essentially, a compact that we would actually say: 'This is the deal by which you come into New Zealand if you want to build out a data centre'," he told 1News.

On grid impact he set a test of additionality, meaning new load matched by new supply, scaled to project size. "It depends a little bit on size as to what would be needed in terms of additionality. But certainly large ones, absolutely, we need to make sure that there is additionality," he said. Speaking to RNZ, he defined the term: "That does mean things like making sure additional electricity generation happens, investments in grid stability, and that they pay for transmission upgrades and those kinds of things."

Luxon rejected the pause itself on investment grounds, saying a one-year moratorium "sends a message to global investors" and that "the answer is not to turn off investment before it's even shown up in the country". Australia ran the same argument when it set its own conditions, and whether operator expectations attract capital or deter it has been contested there since March.

About 100 business leaders met at Invest New Zealand's Auckland offices in late June to discuss building an industry behind AI data centre investment. BCG estimated in February 2026 that positioning New Zealand as a preferred destination could unlock up to NZ$70 billion of economic activity over the next decade.

New York set a 50MW threshold twelve days earlier

The Greens' written release of 26 July 2026 asks for a one-year moratorium on consenting new AI data centres. The release does not specify a capacity threshold. Co-leader Chlöe Swarbrick supplied the 50MW figure in interviews, describing it as the level at which facilities are "defined internationally" as hyperscale, the term for the largest campus class built by or for the major cloud providers.

New York Governor Kathy Hochul signed Executive Order 62 on 14 July 2026, suspending certain environmental approvals for data centres that consume or can consume 50MW or more. The Greens' release cites it as precedent. Hochul announced the measure as a pause of up to a year.

The order itself sets no end date, tying the suspension to completion of a generic environmental impact statement, the state's formal assessment of the sector's effects. A separate Department of Public Service proceeding on large-load connections carries the nearer deadlines, with a technical conference due by 31 December 2026 and a staff white paper by 12 February 2027.

Swarbrick put the New Zealand case for the year. "This is not a ban on data infrastructure. It's a pause on the most resource-intensive developments while New Zealanders get a say on what conditions they should meet," she said. The release argues that councils can consent data centres on a non-notified basis, which under the Resource Management Act means council planners decide without public submissions. Opponents and the Southland mayor have both described the Datagrid consent as non-notified.

Two consented projects sit above the 50MW line

On capacities operators have disclosed, two New Zealand projects clear 50MW, and a pause on new consents would reach neither. Datagrid's Makarewa campus near Invercargill is the larger at 280MW. It received consent from Southland District Council, Environment Southland and Invercargill City Council in March 2026. CDC's Hobsonville Campus Two, at 54MW, is already operating.

The threshold's reach beyond those two turns on figures that are not yet public. TenPeaks, the operator carved out of Spark and backed by Pacific Equity Partners, holds land for a development pipeline of more than 130MW. It has published no split across its three Auckland campuses. CDC's Silverdale campus would also cross the line if it reaches its 60MW+ target, and the Electricity Authority has logged a further 12 prospective data centres whose details are confidential.

Operators also differ on what they are measuring. Most do not say whether a quoted figure is IT load, meaning the servers alone, or total facility draw, which adds cooling and site overheads. The gap between the two commonly runs to 20 per cent or more. A project disclosed in the low 40s of megawatts could therefore sit on either side of the line.

Datacom's facilities and the AWS and Microsoft Auckland cloud regions publish no capacities that engage the threshold. Sharon AI, a Sydney-founded neocloud that rents GPU capacity to AI developers, has signed the largest AI compute contract disclosed for New Zealand at US$1.32 billion. It covers roughly 15MW over five years.

Mercury backs new generation as a condition of new load

Mercury holds a 140MW 15-year power purchase option covering half the Datagrid campus's design capacity. It also paid US$30 million for a 12.7 per cent equity stake in the developer in July 2026. Chief executive Stew Hamilton told RNZ that Mercury accepts the premise behind the government's additionality test.

"We absolutely believe that data centres should be building or should be coming on stream with additional power to make sure that it's contributing to New Zealand's grid," Hamilton said. RNZ reports that the Makarewa build will support more than 1,200 construction jobs and 50 to 80 permanent roles. Construction is due to start within a month, with the campus opening in 2028.

National and Labour both look to Australia's rules

Luxon tied alignment with Australia to keeping social licence, which he said data centres had begun to lose in parts of the world. "If you're looking at our part of the world, Australia and New Zealand, I think having some alignment between the two countries is kind of important in this space," he told 1News.

Labour leader Chris Hipkins said he agreed with "a heck of a lot" of the Australian AI framework, interest.co.nz reported. "If it's bringing new energy generation on stream, that's a good thing. If it's competing with us for our existing electricity, potentially pushing up the price for other businesses and for New Zealand consumers, that's not great," he said.

Greenpeace Australia Pacific called for a national data centre moratorium alongside its Energy Vampires report this year, and the Climate Council's Clouded Future report set out seven rules for managed growth, four of which Australia already meets.

The Australian government published five national expectations for data centre operators on 23 March 2026, covering renewable investment and demand flexibility, and several major operators already met most of them on published evidence. Those expectations are not binding. On 15 July 2026 the government said it would bring them into a single mandatory framework and go further, requiring large data centres to be net generators that put at least as much energy into the grid as they take out. Operators would also pay their full share of grid connection costs and fund any additional water infrastructure. The Australian government aims to take the framework to National Cabinet in August and legislate in early 2027.

What to watch

The principles Luxon commissioned. No deadline has been published for the work, and its scope will decide whether New Zealand ends up with guidance, consent conditions or legislation.

Datagrid's construction start. Earthworks at Makarewa are due within a month on RNZ's reporting, ahead of a 2028 opening.

The three facilities Luxon cited. The Prime Minister said on 26 July 2026 that three data centres would come online within the next 12 months. He has not named them, and no follow-up reporting has identified them.
